The final rule that implemented Section 1557 of the Affordable Care Act (ACA) or ObamaCare went into effect on July 18th.
This particular section prohibits health care providers and entities that are covered from discriminating against anyone on the basis of race, color, national origin, sex, age or disability in any health program or activity that receives federal financial assistance or is administered by an executive agency.
This means that hospitals, clinics, health insurance programs, physician’s practices and health care agencies that receive funds from the government are filed under covered entities. Many of these guidelines are found under federal civil rights law and the government’s interpretation of those laws.

A covered entity has 90 days from when the law went into effect (July 18, 2016) in order to post notices on view to the public as well as beneficiaries, enrollees, and applicants that they are in compliance with the rule. The agencies must also post a non-discrimination tag line and also indicate that language assistance services are available for the top 15 languages spoken by individuals whose English is limited.
